Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WindTrac mobile application and web app (collectively, the "Service"), developed and operated by Rivolu LLC ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms and, for the iOS app, by Apple's standard Licensed Application End User License Agreement referenced in Section 1 below. If you do not agree to these Terms, do not use the Service.

1. License to Use the App (Apple EULA)

Your license to download, install, and use the WindTrac iOS application is granted under Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ (the "Apple EULA"). The Apple EULA is a binding agreement between you and Rivolu LLC, and it governs the scope of your license, permitted uses, restrictions on reverse engineering, consent to use of diagnostic data, termination of the license, export compliance, warranty disclaimers, and limitation of liability with respect to the App itself.

You acknowledge and agree to the following, as required by the Apple EULA:

  • These Terms and the Apple EULA are concluded between you and Rivolu LLC, and not with Apple. Apple is not a party to these Terms.
  • Apple has no obligation whatsoever to provide any maintenance or support services with respect to the App. Maintenance and support, if any, are the responsibility of Rivolu LLC.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of the App, including (but not limited to) product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If there is any conflict between the Apple EULA and these Terms in relation to your license to use the App, the Apple EULA will prevail with respect to that license. These Terms govern all other matters — including the WindTrac Service features, subscription terms, the forecast accuracy disclaimer, and our use of information — as described below.

2. Acceptance of Terms

By using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

WindTrac is an animated, interactive forecast visualization. It displays wind as flowing particle streamlines and renders wave and precipitation data as color heatmaps; offers multiple forecast models selectable per layer; provides timeline playback, tap-to-read values, saved locations, time-zone display options, and (with WindTrac Pro) offline maps and extended forecasts. The Service is provided for general informational purposes only.

WindTrac renders forecast data derived from public sources, including NOAA (GFS and GFS-Wave), DWD (ICON-EU), and ECMWF (AIFS, IFS HRES, and wave models).

4. Free Access and Pro Subscriptions

4.1 Free Access

The full interactive map — including all layers and forecast models, timeline playback, tap-to-read values, and saved locations — is free to use without an account, with forecasts covering the next 72 hours.

4.2 WindTrac Pro

WindTrac Pro is an auto-renewing subscription that unlocks offline maps (downloading a region and forecast for use with no connection) and extended forecasts beyond 72 hours. Pro is offered as a monthly or yearly plan, each beginning with a 7-day free trial. Pro is sold through the Apple App Store, and the subscription paywall and offers within the App may be presented by our paywall provider Superwall; all purchases are processed by Apple.

4.3 Free Trial

Each Pro plan includes a 7-day free trial for eligible users. Your free trial automatically converts into a paid, auto-renewing subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

4.4 Billing

Payment for WindTrac Pro is charged to your Apple ID account at confirmation of purchase (or, for a free trial, at the end of the trial period). Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

4.5 Managing and Cancelling Your Subscription

You can manage or cancel your WindTrac Pro subscription at any time through your Apple ID account settings (Settings → your name → Subscriptions on iOS). Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial billing periods, except as required by law or by Apple's policies.

4.6 Price Changes

We reserve the right to change WindTrac Pro subscription prices. Any price change will take effect at the start of the next subscription period following the date of the price change, subject to applicable Apple consent requirements. Your continued use of Pro after a price change takes effect constitutes your agreement to pay the updated amount.

5. License and Acceptable Use

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own informational and recreational purposes. You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to reverse engineer, decompile, or disassemble the App (beyond what is permitted by the Apple EULA or applicable law);
  • Interfere with or disrupt the Service, or the servers or networks that deliver forecast or basemap data;
  • Scrape, bulk-download, redistribute, sublicense, or resell the Service or the forecast or basemap data delivered through it, except as permitted by the data providers' own terms;
  • Use the Service in any manner that could damage, disable, overburden, or impair it.

6. Forecast Disclaimer — Important

The wind, wave, precipitation, and other data displayed in WindTrac are model-based predictions sourced from third parties. They are provided "as is" and for general informational purposes only, may be inaccurate, delayed, incomplete, or unavailable, and do not account for the full effects of rapidly changing or localized conditions.

You must NOT rely on WindTrac for navigation, aviation, marine safety, search and rescue, commercial operations, or any safety-of-life or otherwise critical decision. Always consult official sources and qualified authorities for any decision where safety, property, or compliance is at stake, follow all applicable regulations, and exercise your own judgment. You assume all risk arising from your use of the forecast data.

7. No Warranty

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, reliability, completeness, timeliness, or availability of the Service or any forecast or basemap data. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Rivolu LLC, its officers, directors, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to use) the Service or any reliance on the forecast data, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of the amount you paid us for the Service in the twelve months preceding the claim, or USD $25.

9. Third-Party Services

The Service integrates with or depends on third-party services that are not owned or controlled by Rivolu LLC, including Apple's App Store and StoreKit; Superwall (subscription paywall display); and the public data sources NOAA, DWD, and ECMWF. Your use of these services, and of the underlying forecast and map data, may be subject to their own terms and attribution requirements. We assume no responsibility for the content, policies, or practices of any third-party service, and you agree that we shall not be liable for any loss arising from your use of them.

10. Intellectual Property

The WindTrac application, web app, website, name, logo, design, and original software are owned by Rivolu LLC and are protected by intellectual property laws. WindTrac is a trademark of Rivolu LLC. The forecast data and basemap tiles displayed in the Service remain the property of their respective providers (including NOAA, DWD, ECMWF) and are subject to those providers' rights, terms, and attribution requirements. Nothing in these Terms grants you any right in our or any provider's intellectual property except the limited license to use the Service described in Section 5.

11. Changes to the Service and These Terms

We reserve the right to modify, suspend, or discontinue any feature, component, data source, or portion of the Service — including the free or Pro tiers — at any time, temporarily or permanently, with or without notice, and without liability to you or any third party. We may also modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice (for example, by posting the updated Terms on our website). Your continued use of the Service after changes take effect constitutes acceptance of those changes.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what information WindTrac does and does not collect. By using the Service, you acknowledge the practices described there.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The Apple EULA is governed by its own choice-of-law provisions and is not affected by this Section.

14. General Provisions

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them freely, including to a successor or acquirer of our business or assets. These Terms, together with the Apple EULA referenced in Section 1 and our Privacy Policy, constitute the entire agreement between you and Rivolu LLC regarding the Service.
